The Business Backbar is operated by Ashley Hohaia, trading as The Business Backbar.

These Terms of Use apply when you visit businessbackbar.com, submit an enquiry or otherwise interact with The Business Backbar online.

In these Terms, “we”, “us” and “our” refer to The Business Backbar. “You” and “your” refer to anyone accessing or using this website.

By using this website, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please discontinue your use of the website.


1. ABOUT THE BUSINESS BACKBAR

The Business Backbar provides digital services for beauty businesses, including website strategy, website design, Shopify development, course-building support, course-platform setup, integrations and related digital business support.

The information on this website provides a general overview of our services. The exact scope, deliverables, fees and conditions for a project will be confirmed separately in writing.


2. WEBSITE INFORMATION

We aim to ensure that the information on this website is accurate and current. However, service descriptions, inclusions, availability, timeframes, examples and other website content may change.

Website content is provided for general information only. It does not constitute legal, financial, accounting, marketing or other professional advice.

Submitting an enquiry, joining an email list or requesting information does not create a client relationship or require either party to proceed with a project.


3. ENQUIRIES, PROPOSALS AND PROJECT AGREEMENTS

After receiving an enquiry, we may request further information before recommending a service, confirming availability or preparing a quote.

A project will only be confirmed once:

a. we have accepted the project in writing;

b. you have accepted the relevant proposal, quote or Client Services Agreement; and

c. any required deposit or initial payment has been received.

Each paid project will be governed by the proposal, quote, scope of work or Client Services Agreement issued for that project.

Those project documents may include specific terms covering:

a. deliverables and exclusions;

b. project fees and payment dates;

c. deposits and cancellation;

d. revision rounds;

e. additional work and scope changes;

f. client responsibilities;

g. content and access requirements;

h. estimated timelines;

i. intellectual property;

j. third-party platforms and subscriptions;

k. testing, launch and handover; and

l. post-launch support.

If there is an inconsistency between these Website Terms of Use and a signed or accepted project agreement, the project agreement will apply to the project.


4. PRICING AND GST

Any prices, starting prices or investment guides displayed on this website are in Australian dollars.

Unless expressly stated otherwise, prices exclude GST.

Website prices and package descriptions are general guides only. A final project fee will depend on the agreed scope, number of pages, required integrations, content requirements, additional services and level of support.

We will confirm the applicable price before a project begins. Additional work outside the agreed scope will not be undertaken without discussing the change and any resulting fee or timeline adjustment.


5. PROMOTIONAL OFFERS

From time to time, we may make introductory, launch or promotional offers available.

Additional conditions may apply to an offer, including eligibility requirements, expiry dates, project commencement periods and limitations on combining offers.

Where an offer includes separate terms, those terms will apply in addition to these Terms of Use. Promotional offers are not redeemable for cash and do not create a project booking until the project has been formally accepted and confirmed.


6. CLIENT RESPONSIBILITIES

If you engage The Business Backbar, you may be required to provide information, content, brand assets, photographs, website access, platform access, approvals and feedback.

You are responsible for ensuring that:

a. the information you provide is complete and accurate;

b. you have permission to use all supplied text, images, videos, fonts, logos, testimonials and other materials;

c. your content complies with applicable laws and does not infringe another person’s rights; and

d. account access and instructions are provided securely and within the agreed timeframe.

Project timelines may be affected if required content, access, approvals or feedback are delayed. The consequences of client delays will be addressed in the applicable project agreement.


7. RESULTS AND BUSINESS OUTCOMES

We provide strategy, design and digital services intended to support your business and improve its online presence.

However, we do not guarantee any particular level of revenue, bookings, enquiries, course sales, website traffic, search-engine rankings or other commercial outcome.

Business results can be affected by factors outside our control, including your offers, pricing, reputation, marketing, audience, competition, content, client experience and ongoing use of the completed work.

Case studies, testimonials and previous project outcomes are examples only. They do not guarantee that another business will achieve the same result.


8. THIRD-PARTY PLATFORMS AND SERVICES

Our website and client projects may refer to or use third-party platforms and services, including Shopify, Thinkific, Timely, Flowdesk, domain providers, booking systems, course platforms, payment providers, applications and other integrations.

Third-party services are governed by their own terms, privacy policies, pricing and availability.

We do not control third-party platforms and cannot guarantee that they will remain available, error-free or unchanged. We are not responsible for an outage, policy change, price change, discontinued feature or technical issue caused solely by a third-party provider.

Any third-party subscription, application, domain, platform or transaction fee will be the client’s responsibility unless expressly included in an accepted project proposal.


9. INTELLECTUAL PROPERTY

Unless otherwise stated, the content of this website is owned by or licensed to The Business Backbar. This includes the website design, text, copy, graphics, illustrations, photographs, videos, branding, layouts, concepts, templates and downloadable materials.

You may view this website for personal and legitimate business-research purposes.

You must not copy, reproduce, republish, sell, distribute, modify or commercially exploit our website content without prior written permission.

You must not represent our work, designs, copy, concepts or case studies as your own.

Intellectual-property ownership for work created during a paid client project will be governed by the applicable proposal or Client Services Agreement. Nothing in these Website Terms automatically transfers ownership of our templates, methods, code libraries, design systems, working files or background intellectual property.


10. CLIENT AND THIRD-PARTY MATERIALS

All trademarks, logos, photographs, website imagery and other materials belonging to clients or third parties remain the property of their respective owners.

Client projects displayed on this website are shown for portfolio and promotional purposes with the relevant permission or authority.

You must not copy or reuse a client’s branding, photographs, course materials or other protected content from our website.


11. ACCEPTABLE USE

You must not use this website:

a. for an unlawful, fraudulent or malicious purpose;

b. to infringe our rights or another person’s rights;

Where the Australian Consumer Law applies, our services come with guarantees that cannot be excluded by these Terms.

Any refund, cancellation or remedy will be assessed in accordance with the applicable project agreement and any rights available under Australian law.


15. WEBSITE AVAILABILITY

We aim to keep this website available and functioning properly, but we do not guarantee continuous, uninterrupted or error-free access.

We may update, suspend or remove website content where reasonably required for maintenance, security, business changes or other operational reasons.


16. LIMITATION OF LIABILITY

To the extent permitted by law, The Business Backbar is not responsible for loss arising solely from:

a. your reliance on general website information without obtaining advice appropriate to your circumstances;

Liability relating to a paid client project will also be governed by the applicable project agreement.


17. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our website, services, business practices or legal obligations.

The current version will be published on this page with an updated effective date. Changes will apply from the date they are published and will not retrospectively alter an existing signed project agreement unless both parties agree in writing.


18. SEVERABILITY

If any part of these Terms is found to be unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary.

The remaining provisions will continue to apply.


19. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

You and The Business Backbar submit to the jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.
